WHAT TO DO IF YOU ARE INVOLVED IN AN ACCIDENT:



Hopefully you will never have an accident, but if you do, the following are some things for you to remember:
  1. Do not move the vehicle unless you need to for safety reasons.

  2. Call the police.

  3. Obtain other driver's information.

  4. Go to the hospital immediately if you are injured.

  5. Give only basic information.

  6. Notify your insurance company right away.

  7. Do not sign anything.

  8. Take photos of your injuries and your property damage.

  9. Have your vehicle damage appraised.

  10. See a doctor for follow-up treatment.

  11. Contact our office.

if you're involved in an accident

hiring a lawyer:

  1. We are hired when you say so by signing a fee agreement.  We are only paid if we settle your case.  In almost all cases we are paid 33-1/3% of what the At Fault driver's insurance company pays you.  You don't bring money in to hire us, and we will never get paid more than what you will receive.

  2. If you hire us you will sign a lot of medical releases and other authorizations so we can get the records that will support your claim to the at fault driver's insurance company. 

  3. We will interview you and ask you many questions, some of which you may not have considered.

  4. In most cases we will obtain all the records, documents and the photos we need.  Sometimes we need your help on these issues.

  5. Once you hire us, we notify the at fault driver's insurance company to only deal with us regarding your injuries and how the accident happened.  We'll get them out of your hair.

  6. If you haven't contacted the at fault driver's insurance company we will do if for you once you hire us.

  7. Bottom line:  Once you hire us we take over.

client responsibilities:

We will assist you in working out your property damage issues at no cost to you, unless we have to file suit in order to obtain compensation for your property damage.  Having to file suit over property damage is pretty unusual.  Again, we assist you, but you have the lead on this because you have the bike and will best be able to coordinate with the at fault driver's insurance company when they need to come see the bike.

You will need to see medical providers for your injuries.  If you need help finding the right doctor we usually can make some solid recommendations.  Depending on the severity of your injuries, treatment and follow up with your doctors may last weeks or even years.  For may reasons, not the least of which is your own personal health, follow up with your doctors and adherence to their direction and advise is your most important responsibility.

Paying for your medical care before your case is settled is often difficult, tricky and sometimes simply not possible.  The dilemma is that in order for us to recover all that you are entitled to you must be diagnosed and treated by the appropriate doctors.  If you don't have medical insurance then how do you recover fair compensation and receive the treatment you need?

We help with these issues from scouring your scott's insurance policy to finding sources, to dealing with health insurance providers, to working out an arrangement for the doctor to wait for payment until the case is resolved.

Keep in mind though, 99% of the time when an insurance provider pays for your medical care they get paid back when you settle your case.  This is another reason to make sure you have received all the medical treatment you need before settlement of your case.  It is our job to make sure the at fault driver's insurance company pays back all your medical bills to your doctors or your insurance company in addition to what they owe you for lost wages, pain and suffering and any disability.

settlement:

While you are treating with your doctors, my staff and I will contact your medical providers and pay their set fees to provide us copies of all of your records.  We do this as well with your employer so we can document your lost wages.  This is important, as we need to fully comprehend your injuries and monetary damages early on, but we also have to inform the at fault driver's insurance company as well, so that they are prepared to settle your case when you complete your medical care. 

Once your doctors release you, we will request they write us a final report documenting all of the care they provided you.  More importantly though, they will address whether you will endure any future disability and or require any future medical care.

At this point we are ready to issue a formal demand to the at fault driver's insurance company.

Before that demand package goes to any insurance company though, we sit down with you, or send it to you, for your review.  Whichever you prefer.  We do this so you can make sure the demand not only includes every medical record and bill related to your injuries, and any lost wages, but also to make sure it depicts the impact your injuries have had and may continue to have on your life. 

Once you have approved the demand we send it along with all of the supporting documents and evidence to the insurance company.  Once the insurance company has evaluated the claim they typically get back to us in 30 to 60 days with a first offer.  Once any offer is received we will personally call you and advise you of the offer and get your thoughts and give you our thoughts on the offer.

We will stand by you through this entire process to help make sense out of it and explain it to you step by step.  We'll fight to get you everything you deserve and are entitled to.

At the end of the settlement process, if the final offer is not acceptable to you we, at your direction and hopefully following our advice, will file suit in court

lawsuit:

In the end, if the at fault driver's insurance company doesn't make a reasonable offer or one that is acceptable to you, we will work with you and file suit.  There are a number of reasons why your claim may end up in court.  1.  A dispute over who was at fault in the accident. 2.  The statute of limitations is close to expiring.  3.  The insurance company just won't make a decent offer.

The good news is that most cases settle before we have to file suit or are settled after filing suit, but before you have to go to court.  The bad news is the court process can be slow, aggravating and sometimes downright insulting.  Again, we'll be there every step of the way fighting for you and explaining the process to you.

Bottom line:  We will do our best to make sure you don't get taken advantage of by an unfair and greedy insurance company.
